Welcome to Textedly (“the App”), a texting application that allows you to send and receive messages, share media, and interact with others. By using the App, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

  1. Eligibility

To use the App, you must be at least 18 years old. By agreeing to these Terms, you confirm that you are of the required age or older to use the App.

  • Account Creation: To access certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password.
  • Accuracy of Information: You agree to provide accurate, current, and complete information during registration and to keep this information updated.
  • Account Responsibility: You are solely responsible for any activities that occur under your account, whether or not authorized.
  1. Program Description

By Signing up you will receive text messages about NOAS foster care services, events, and fundraising opportunities, including those hosted by NOAS or its partners.

  1. Message Frequency

The number of messages you receive will depend on the specific NOAS messaging program you join, and the frequency of messages sent by those programs.

  1. Cost

Standard message and data rates may apply as per your mobile carrier’s rate plan. Please check with your carrier for details, including any potential roaming charges.

  1. Use of the App
  • Permitted Use: You agree to use the App solely for lawful purposes and in accordance with these Terms. You shall not use the App to:
    • Send unsolicited or spam messages
    • Harass, abuse, or threaten other users
    • Violate any laws or regulations
    • Impersonate any person or entity or mislead others
  • Content Sharing: By sending messages or sharing content (including text, images, videos, etc.), you grant the App a worldwide, non-exclusive, royalty-free license to use, store, and distribute your content solely for the purpose of providing the App’s services.
  1. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

  1. Restrictions

You agree not to:

  • Decompile, reverse-engineer, or disassemble the App
  • Modify, adapt, or hack the App in any way
  • Use the App to transmit viruses, malware, or harmful code
  • Engage in any activity that could harm, disrupt, or impair the App’s functionality
  1. Third-Party Services

The App may contain links to third-party websites or services that are not controlled or owned by Textedly. We are not responsible for the content, privacy policies, or practices of third-party sites. You acknowledge and agree that we are not liable for any damage or loss caused by third-party content or services.

  1. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may also delete your account at any time through the App’s settings. Upon termination, your access to certain features may be restricted, and any content shared may be deleted.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, Textedly and NOAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data arising from your use of the App.

  1. Indemnification

You agree to indemnify and hold harmless Textedly and NOAS, its officers, directors, employees, and agents from any claim, liability, loss, or expense arising from your violation of these Terms or your use of the App.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ohio. Any disputes arising out of or relating to these Terms shall be resolved in the competent courts of Ohio.

  1. Changes to Terms

We may modify or update these Terms at any time. You will be notified of any material changes to these Terms, and continued use of the App will constitute your acceptance of the revised Terms.
